This Agreement (this "Agreement") is entered into between U.S. Bank (the "Bank") and any customer of the Bank who subscribes to U.S. Bank Online with Financial Management Software (the "Service"). The customer is referred to in this Agreement as "you". U.S. Bank Online with Financial Management Software is referred to as "U.S. Bank Online with a PFM". Online Access with Financial Management Software is referred to as "Account Access with a PFM." Bill Payment with Financial Management Software is referred to as "Bill Pay with a PFM."
This Agreement contains the terms of your subscription to the Services. You should read this Agreement and the related material provided by the Bank before you use the Services. If you use the Services or permit another to use the Services on your behalf, you agree to the terms stated in this Agreement. You agree that the Bank may provide any notices required by law or by this agreement in electronic form, including electronic mail. By using this Service, you represent your consent and ability to receive notices that the Bank may provide in an electronic format.
The terms in this Agreement are in addition to (a) the terms of any deposit account agreements you have with the Bank, including your signature card, the booklet containing the terms of your accounts, the accompanying schedules, and any change of terms notices (together, the "Deposit Agreements"), and to (b) the terms of any credit agreements you have with the Bank or with an affiliated bank, including any disclosures made pursuant to such agreements (together, the "Credit Agreements").
3.1 FOR U.S. BANK ONLINE® WITH A PFM AND INTERNET BILL PAY
You will need a computer, related equipment, and certain software in order to use U.S. Bank® Online with a PFM and Bill Pay with a PFM. (In this Agreement, your computer, the related equipment, certain software, and as applicable Internet access are referred to together as your "Computer"). You are responsible for the installation, maintenance, and operation of your Computer. The Bank is not responsible for any errors or failures from any malfunction of your Computer, for any virus, other problems or changes that may be associated with the use of your Computer, including, for example, the cost of your Internet service provider. Also, your software may include certain functions and features (such as home budgeting and mortgage comparisons) that do not relate directly to or interact with your accounts at the Bank. The Bank is not responsible for such functions and features.
U.S. Bank Online with a PFM software includes two separate functions:
Your subscription may include one or more of these functions. Depending on your software, one or more of these functions may not be available. These functions and their limitations are described below.
- Online Account Access and
- Online Bill Pay
4.1 ACCOUNT ACCESS WITH A PFM
You may use Account Access with a PFM to:
- Obtain account balances and transaction information for certain bank accounts,
- Transfer funds between certain bank accounts, and
- Send electronic communications to the Bank and receive electronic communications from the Bank.
To subscribe to Account Access with a PFM, you must have at least one checking account with the Bank and a U.S. Bank® Check Card, with the exception of business accounts that don't require a U.S. Bank Check Card. If you have multiple accounts at the Bank, you may "link" them together. The following types of accounts may be linked together:
- Checking accounts
- Savings accounts
- Money market savings accounts
- Line of credit accounts
- Credit card accounts
In most cases, you may use Account Access with a PFM to link deposit accounts in which you have an unrestricted right to withdraw funds and credit accounts in which you have an unrestricted right to borrow money and buy items on credit. However, the Bank reserves the right in its sole discretion to deny U.S. Bank Online account linkage and account transactions. When you use Account Access with a PFM to make transfers from credit accounts, you agree that the Bank may take any action required to obtain cash advances on your behalf, including charging your linked credit account at the Bank or at an affiliate bank, without your signature.
4.2 BILL PAY WITH A PFM
To subscribe to Bill Pay with a PFM, you must have at least one checking account with the Bank. You may use Bill Pay with a PFM to:
- Make payments to a person or business (a "payee") in the United States,
- Make automatic recurring payments, and
- Review, change, and cancel payments.
When you use Bill Pay with a PFM, you must designate the account from which the Bank is to make payment (the "Payment Account"). A Payment Account must be either a checking account or a money market savings account. To pay bills using Bill Pay with a PFM, you must use your Computer to authorize a payment from a Payment Account. After the Bank receives your instruction, the Bank will make your payment.
