The following documents are the Foreign Bank Certifications of the off-shore financial institutions owned by U.S. Bancorp and its affiliates. These certifications have been prepared in accordance with the USA Patriot Act Sections 313 and 319.
USA Patriot Act Section 313 prohibits certain financial institutions from providing correspondent banking accounts to shell banks -- banks that do not have a physical presence in any country -- and requires those financial institutions to ensure that the correspondent accounts they provide to foreign banks are not providing services to shell banks.
Section 319 requires financial institutions that provide correspondent accounts to foreign banks to maintain a record of the foreign bank's owners and to maintain the name and address of an agent in the United States designated to accept service of legal process for the foreign bank. This Section also allows financial institutions to rely on a Foreign Bank Certification and provides a safe harbor if the institution obtains the form of certification or a re-certification at least once every three years.
